A Federal High Court sitting in Osogbo, Osun State, on Monday dismissed the suit filed by the All Progressive Congress (APC), seeking to restrain the conduct of the Local Government election in Osun State and to stop Federal allocations to Thirty (30) Local Government Areas.
Osun APC filed the suit through their lawyer Adeoye Galadima against Osun State government, Attorney General of the federation, Minister of Finance, Accountant General of Federation and Three (3) others.
Galadima told the Court that the decision taken by the Governor Ademola Adeleke to appoint Caretakers into all the Local Government Councils is in contravention of the rights conferred on his clients.
He stated that refusal of the Governor Ademola Adeleke to pay of the Plaintiffs payments, benefits, allowances, salaries to which the Plaintiffs (being elected officers of the Local Government Councils) are entitled is in violation of the Plaintiffs’right as guaranteed by the provisions of the electoral Act 2022.

Also urged the Court to directing the Minister of Finance and Accountant General of the Federation to ensure that funds meant for disbursement to all the 30 Local Government councils of Osun State are withheld.
Counsel to the Osun State Government and (4) four other Barrister Bamidele Salawu from the Ministry of Justice, opposed the claimed of APC Counsel.
Bamidele filed objection against APC that the purported election of Local Governments Chairman and
Councilors under the platform of All Progressive Congress (APC),was nullified and they were consequently sacked from office, by the Judgment of this Honourable Court, delivered on 25″ November, 2022 in Suit No. FHC/OS/CS/94/2022, between;
Peoples Democratic Party V Independent National Electoral Commission (INEC).

The above referred judgment, held the Plaintiffs purported election
under the platform of All Progressive Congress (APC),and occupation of the Local
Government offices pursuant to the election conducted on 15 Oct. 2022, as unconstitutional, invalid, null and void for violation of the Constitution and breach of
sections of the Electoral Act 2022 and all persons or individuals occupying offices in the State Local Government by the said election were accordingly sacked from
holding such offices.
Justice Adefunmilola Demmy-Ajayi in his judgement dismissed the suit and awarded cost of One million naira against APC counsel Muhyideen Galadima for his unprofessional conduct and abuse of court process.
The court also awarded two hundred thousand naira against all claimants for abuse of court.
